Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LiveMortgageLeads4U website, APIs, and lead generation services (collectively, the "Services"). By registering for an account, purchasing leads, or otherwise accessing the Services, you agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

1. Lead Purchases & Delivery

LiveMortgageLeads4U provides data marketing services by delivering consumer information ("Leads") and live call transfers to our clients ("Buyers").

• Delivery: Leads are delivered in real-time via API, email, or direct CRM integration. Live transfers are routed directly to the phone number(s) provided in your account dashboard.
• Data Accuracy: While we utilize strict pre-screening funnels and validation tools, we do not guarantee the absolute accuracy of consumer-provided data or that any given Lead will result in a funded loan.
• Exclusivity: Leads marked as "Exclusive" are sold only to you and will not be resold to any other buyer. "Shared" leads may be distributed to a maximum of three (3) total buyers.

2. Payment Terms & Refund Policy

Access to our Services requires a pre-funded account balance or an approved credit facility.

• Billing: You will be charged automatically on a per-lead or per-transfer basis according to the pricing tier and filters selected in your account.
• Insufficient Funds: If your account balance falls below the cost of a lead, lead delivery will be paused until the account is replenished.
• Return Policy: Returns are only accepted for invalid leads (e.g., disconnected phone numbers, obviously bogus contact info like "Mickey Mouse," or explicit non-compliance with your requested state filters). Returns must be requested within 48 hours of lead delivery via the client dashboard.
• All Sales Final: Except for accepted returns under the conditions above, all lead purchases are final and non-refundable.

3. Buyer Compliance Obligations (Strict)

As a Buyer of our Leads, you bear the sole responsibility for complying with all applicable local, state, and federal laws when contacting consumers. You explicitly agree to:

• Comply with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), and all applicable Do Not Call (DNC) registry rules.
• Honor any and all consumer requests to "opt-out" or "do not call" immediately.
• Maintain all necessary state and federal licensing required to originate or broker mortgages in the jurisdictions where you purchase leads.
• Not resell, distribute, syndicate, or broker any Exclusive Leads purchased from LiveMortgageLeads4U to any third party.

4. Intellectual Property

The Services, including the website design, text, graphics, APIs, routing software, and lead generation funnels, are owned by or licensed to LiveMortgageLeads4U and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of our platform without explicit written consent.

5. Limitation of Liability

To the maximum extent permitted by law, LiveMortgageLeads4U and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; or (b) any conduct or content of any third party on the Services, including but not limited to the actions of the consumers whose data is provided as Leads.

6. Indemnification

You agree to defend, indemnify, and hold harmless LiveMortgageLeads4U, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms or any applicable law (including TCPA violations).

7. Modifications to the Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will notify you by updating the "Last Updated" date at the top of these Terms and, where appropriate, by communicating with you via email or through the client dashboard. Your continued use of the Services after such notification constitutes your acceptance of the new Terms.
